Legal Notice

Version 2026.10.27-1, in force since 27 October 2026

Read the Italian original

Who publishes the BGates website, who owns the texts, images and trade marks, how the photographs are made, what the reviews and prices you read are worth, and which law applies.

Courtesy translation. In case of discrepancy, the Italian text prevails.

This page says who publishes the BGates website, who owns the content you find on it, what the information you read is worth and which law applies.

It is not a contract and we do not ask you to accept it: the law requires us to make certain information about the company public, and this is the page where it is. The rules of the relationship between you and us are elsewhere, and § 11 tells you in which document.

It concerns the GT PRO 4G model and the related Service. It does not concern the earlier models that work by SMS messages only, nor the Bluetooth channel.

1. Who publishes this website

The BGates website is published by:

Company nameBusiness Gates S.r.l.

In the rest of this page Business Gates S.r.l. is referred to as BGates.

This information is published because two provisions require it, and we cite them because they help you understand why this page exists:

  • Article 7 of Legislative Decree no. 70 of 9 April 2003 (electronic commerce) requires the name, registered office and contact details — including the email address — the companies register or REA registration number and the VAT number to be ‘easily, directly and permanently accessible’. That is why the same block appears at the bottom of every page of the website, of the BGates Private Area, of the BGates app and of the activation procedure, and not only here;
  • Article 2250 of the Codice civile (Italian Civil Code) requires the registered office and the companies register office with which the company is registered to be stated in its documents and correspondence. Paragraph 7 extends these obligations to the ‘electronic space intended for communication connected to a publicly accessible telematic network’: that is, to this website. The details are those in the table above.

BGates has not appointed a Data Protection Officer. Requests about personal data are sent to info@bgates.it, and the reason why no DPO has been appointed is explained in the Privacy Notice.

2. What this website is, and what it is not

The BGates website is an information showcase. It presents the Device, the Subscription Plans and the Service, and explains what they are for.

On this website you do not open an Account, you do not buy and you do not pay. This is how things stand:

What you want to doWhere it is actually done
Read about the product and the Planshere, on the BGates website
Buy the Deviceon the online shop at shop.bgates.it, which is hosted on a third-party platform, or from a Distributor or an Installer
Take out or renew the Subscriptionin the activation procedure and in the BGates Private Area
Administer an Entrance, authorise and revoke Authorised Numbersin the BGates Private Area and in the BGates app

The only form on the website is the one on the quotation page. Today that form sends nothing to any server: it composes a text that stays on your device and suggests that you phone us. The two buttons that would open email or WhatsApp are not present, because the two contact channels have not yet been activated. This is how it is designed.

When the two contact channels are activated, the privacy notice will appear before the buttons and, for the WhatsApp button, the warning that the conversation goes through Meta Platforms Ireland Ltd. The retention periods for what you write to us will be those in the Retention Policy: we do not state any here, because today we receive nothing and a figure written in advance would be an invented figure.

3. Intellectual property

3.1 What is ours

The texts, the page structure, the graphics, the photographs, the videos, the illustrations, the three-dimensional models, the trade marks, the logos, the name BGates, the website software, the software of the BGates Private Area and of the BGates app and the Device firmware belong to Business Gates S.r.l. or to its predecessors in title, and are protected by Law no. 633 of 22 April 1941 (Italian Copyright Law) and by Legislative Decree no. 30 of 10 February 2005 (Codice della proprietà industriale, Italian Industrial Property Code).

3.2 What you can do without asking us

  • read, consult and print the pages for personal use;
  • share the link to a page, with whomever you like;
  • quote passages of the texts, stating the source and the link to the page you took them from;
  • download and keep the legal documents and the manuals that we make available, and hand them to the people who need them — for example the Notice for people authorised to open an entrance, to the people you authorise.

3.3 What you cannot do without our written consent

  • reproduce, republish or distribute the content of the website, in whole or in part, on other websites, catalogues, marketing materials or social networks, even in modified form;
  • systematically extract texts, images, videos or data from our pages, with automated tools or by hand;
  • use the name BGates, our trade marks and our logos as your own distinctive signs, in a domain name, in a profile or in a commercial communication, or in a way that suggests a partnership, affiliation or resale relationship that does not exist;
  • remove or alter distinctive signs and attribution notices from the files you download.

Distributors and Installers who resell or install the Device may use the BGates name and materials within the limits of the contract they have with us: that contract prevails over this page.

3.4 Text and data mining for training artificial intelligence systems

We expressly reserve the use of the content of this website for text and data mining, including the training and fine-tuning of artificial intelligence systems. The reservation applies to all the content of the website and is not overridden by the fact that a page is freely accessible.

3.5 Other parties' trade marks and names

The names and trade marks of other companies that appear on the website and in our documents — including WhatsApp and Meta, Stripe, Vodafone, Shopify, Aruba — belong to their respective owners and are mentioned only to describe what each of them does in our service. Mentioning them does not indicate any sponsorship or endorsement by them. The role of each supplier, its country and the safeguards for transfers are in the Suppliers document.

3.6 Third-party components used on the website

Some parts of the website use other parties' components, under their own licences. Those we know of:

ComponentWhereLicence
City Kit (Suburban) three-dimensional models by Kenneythe three-dimensional model of the workshopCC0 1.0: free use, including commercial use, with no attribution requirement
Schibsted Grotesk typefaceall pages, hosted on our serversthe typeface's licence
three.js graphics librarythe three-dimensional modelthe library's licence

4. Photographs, videos and images generated with artificial intelligence

4.1 How the images you see are made

Almost all the setting photographs on the website — houses, gates, front doors, entrances, desks, hands — were generated with an artificial intelligence system, not taken by a photographer. The photograph of the Device, on the other hand, is a real photograph of the product: the unit you see is the one you receive.

No real people appear in the generated images: the figures are almost always seen from behind and cannot be recognised. No image portrays an identifiable person, and for this reason the authorisations for the use of a person's likeness required by copyright law (Articles 96 and 97 of Law 633/1941) are not needed. This is how it is designed.

4.2 Why we say so

Regulation (EU) 2024/1689 on artificial intelligence, Article 50 of which applies from 2 August 2026, requires anyone who uses an artificial intelligence system that generates images, audio or video resembling ‘existing persons, objects, places, entities or events’ to disclose that the content has been artificially generated (Art. 50(4) and Art. 3, point 60). A synthetic photograph of a villa or a gate, on the website of the company that sells those products, falls within that description.

That is why every page containing generated images carries, in the note at the bottom, the wording ‘Immagini generate con intelligenza artificiale’ (Images generated with artificial intelligence), and the image inventory states, file by file, which images are generated and which are not.

5. Reviews and ratings

The website shows the rating ‘4,6 su 5 · 155 recensioni’ (4.6 out of 5 · 155 reviews), accompanied by the line ‘Valutazione dichiarata su bgates.it’ (Rating stated on bgates.it).

We say precisely what this means, because that is what the law requires:

  • we do not collect reviews on this website: there is no form here for leaving one;
  • the rating shown is the figure published on the online shop at shop.bgates.it, which is hosted on a third-party platform (Shopify) and uses a third-party review collection service (judge.me);
  • we do not check one by one the reviews that make up that figure, and we do not claim that they all come from people who actually bought or used the product;
  • we do not write fake reviews, we do not commission them from anyone and we do not pay anyone to write them, nor to leave better ratings than those customers give.

The rules are Article 22(5-bis) of the Codice del consumo (Italian Consumer Code), under which, where a trader provides access to consumer reviews, information stating whether and how the trader ensures that the reviews come from people who actually bought or used the product is material information; and Article 23(1)(bb-ter) and (bb-quater), which regards as misleading in all circumstances stating that reviews come from real purchasers without taking reasonable steps to verify it, and submitting or commissioning fake reviews.

6. Links to other parties' websites and services

The website contains few external links, and they are these:

LinkWhere it leadsWhat it involves
The telephone numberopens the phone application on your deviceyou call us, and we see your number
‘Entra’ (Sign in) and the references to the private areaBGates Private Areait is ours: the Terms of Use and the Privacy Notice apply
The link to the Notice for people authorised to open an entranceBGates appit is ours
The ‘Mandalo su WhatsApp’ (Send it on WhatsApp) button on the quotation pageWhatsApp, that is Meta Platforms Ireland Ltd.not present today, because the company WhatsApp number has not been activated. When it is, we will tell you before you leave the page
The online shop at shop.bgates.itShopify platformit is a different channel, with its own terms of sale and its own privacy notice

When you open someone else's website or service, you leave ours: from that moment the terms and privacy notice of whoever runs it apply, and it is they who process your data. We do not control those websites and we are not answerable for their content, their availability or what happens on them: not because we are shielding ourselves by contract, but because they are not ours and we cannot govern them. What we are answerable for is the choice to place that link and the fact of telling you where it leads.

If you find a broken link on our website, or one that leads to improper content, write to us at info@bgates.it: we will remove it.

Anyone who wants to place a link to the BGates website may do so freely, to the home page or to an internal page, provided that the link does not suggest a commercial relationship that does not exist and does not show our pages inside a frame that makes them look like someone else's.

7. What the information you read is worth

7.1 Technical information and prices

The descriptions, technical sheets, times, figures and images on the website are there to help you understand what the product does. We keep them up to date and check them, but the website is not the technical documentation of the Device and it is not an installation instruction: for installing and connecting the Device, the manual and the instructions supplied with the product apply, and the rules on the Entrance's automation remain those of the installation, which is not ours.

The prices shown on the website are those in force at the time the page was published, and they may change. The price that binds you is the one you see at the time of the order, in the activation procedure or on the sales channel, with the total and taxes: that is the price that goes into the Terms of Sale and the order confirmation.

Note one thing, because it works in your favour: the information we give you before you order, including what is written on these pages, forms part of the contract and we cannot change it on our own afterwards (Art. 49(5) of the Codice del consumo). So if a page promises a feature, that feature is owed to you. If you find one that does not match, report it to us: it is our error to correct, not carelessness on your part.

7.2 What we do not promise

The website may contain clerical errors, typos or information that is no longer current. We correct whatever is reported to us. We do not promise that the website will always be reachable or free from interruptions: it is a showcase, and its unavailability does not affect the operation of the Service, which has its own rules.

It must be said clearly, and it also applies to what you read here: the BGates Service is not a security system or an emergency system. Whoever administers an Entrance must keep an alternative way of opening it. The consequences of this, and the allocation of risk, are in the document Limitations of Liability and Availability of the Service.

7.3 What we cannot exclude, and do not exclude

This page does not limit our liability. Even if it did, there are limits that no text can override, and we state them so that you know they remain in full:

  • liability for wilful misconduct or gross negligence cannot be excluded or limited: any agreement providing for it is void (Article 1229 of the Italian Civil Code);
  • liability for harm to the life and health of persons cannot be excluded or limited;
  • if you are a Consumer, all the rights that the Codice del consumo grants you as mandatory remain intact: conformity of the goods and of the digital service, remedies, withdrawal, guarantees. No clause of ours, in any document, reduces them.

8. Reports

What you want to reportTo whom
An error on a page, a broken link, a wrong priceinfo@bgates.it
A vulnerability or a security probleminfo@bgates.it, with ‘sicurezza’ (security) in the subject line
A request about your personal data (access, rectification, erasure, objection)info@bgates.it
Content that you believe infringes one of your rights — an image, a text, a trade markinfo@bgates.it

For reports of infringement of a right, state who you are, which content (with the address of the page) and why you believe the right is yours. We check and, if the report is well-founded, we remove or correct the content. How we handle security breaches and incidents is described in the document Breach and Incident Management.

9. Personal data and cookies

This page does not describe the processing of personal data: the dedicated documents do that, and here we only refer to them.

  • Privacy Notice: who processes your data, for what purposes, on what legal basis, to whom we disclose it, what you can ask for.
  • Cookie and Local Storage Notice: what is saved on your device and what your browser contacts. In short: the website does not write cookies, does not use statistical analytics tools, pixels or profiling, and saves a single technical interface preference in the browser's local storage.
  • Data Retention Policy: how long we keep each category of data and why exactly that long. Retention periods are set out only there: if you find them repeated elsewhere, that document prevails.
  • Suppliers and sub-processors: who receives what, in which country, with which safeguard. The suppliers that directly concern the pages of the website are netcup GmbH (Nuremberg, Germany), which hosts our servers, and the third-party services named in § 6.

10. Governing law and disputes

The BGates website and this Legal Notice are governed by Italian law.

If you are a Consumer, that is an individual acting for purposes outside your trade, business or profession, this choice does not deprive you of the protection afforded to you by the mandatory provisions of the European Union country in which you habitually reside. And for disputes, the mandatory territorial jurisdiction of the court of the place where you reside or have elected domicile applies, if in Italy (Art. 66-bis of the Codice del consumo). This page does not impose any other court on you.

Before going to court you can write to us at info@bgates.it: we will reply within 30 days with a proposed solution. You can also turn to an alternative dispute resolution body: an ADR body entered in the list kept by the Ministero delle Imprese e del Made in Italy (Italian Ministry of Enterprises and Made in Italy) (www.mimit.gov.it). The European ODR platform no longer exists: it was discontinued on 20 July 2025. Turning to an alternative dispute resolution body does not take away your right to go to court.

If you are not a Consumer, the clauses on jurisdiction and governing law are those of the Terms of Use of the Service, the Terms of Sale and the Terms for Customers and Administrators, which are accepted and, where provided, specifically approved. This page does not add to or change any of them.

11. Relationship with the other documents

This page concerns the website. The relationship between you and us is described elsewhere, and in case of difference the specific document prevails:

Version 2026.10.27-1 — in effect from 27 October 2026. When we change something substantial — a new purpose, a new supplier, a longer retention period — we publish the new version here, with its date, and if you have an Account we tell you by email. This document is not accepted: it is read, and we do not ask you to tick any box. Corrections of form do not change the version. Previous versions are available on request from info@bgates.it.
